Agreement to terms

These Terms of Service ("Terms") are an agreement between you and Apollo Wellness LLC ("Company," "we," "us," or "our") governing the Apollo Suite — the apollo-suite.com account hub, the Alluvium, Welkin, and Hearth products, their websites and mobile apps, and any related services (collectively, the "Services"). By creating an account, subscribing, or using any of the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

You must be at least 18 years old and able to form a binding contract to create an account. The Services are offered for personal, household use in the United States. By using the Services you represent that these things are true and that the information you provide is accurate.

Your account

  • One Apollo account signs you in to every product. Sign-in is by one-time email link/code or Google sign-in; keep control of your email account, because anyone who controls it can access your Apollo account.
  • Notify us promptly of any unauthorized access.
  • You may not sell, transfer, or share your account, and you may not use the Services for unlawful purposes.
  • We may suspend or terminate accounts that violate these Terms, create security risk, or abuse the Services.

Households

You can form a household and invite others to it. An active subscription held by the household owner covers all household members for the subscribed products.

  • Invite only people you know and intend to share with. Household members can see one another's names and email addresses.
  • Each product has its own sharing rules, described in the Privacy Policy: in Alluvium, only accounts you explicitly mark shared are visible to your household; in Hearth, items you create are shared with your household by default unless you mark them private; Welkin data is never shared through the household.
  • Shared items are co-editable: household members can modify (but not hard-delete) items shared with them. Deleting a shared item removes it for everyone.
  • The household owner can remove members; members can leave. Leaving or being removed ends both entitlement coverage and access to household-shared data.

Subscriptions and billing

  • Subscriptions are sold on our website and billed by Stripe. The price, billing interval (monthly or annual), and any free-trial terms are those displayed at checkout.
  • Subscriptions renew automatically at the end of each billing period, and your payment method is charged at the then-current price, until you cancel.
  • If your plan includes a free trial, you can cancel before the trial ends and you will not be charged. If a card is required, we will tell you before the trial converts to a paid subscription.
  • Cancel anytime from your Account page (Manage billing), which opens the Stripe billing portal, or by emailing support. Cancellation stops future charges; your access continues until the end of the period you've paid for.
  • Except where required by law, payments are non-refundable and we do not give refunds or credits for partial periods. If you think you've been charged in error, contact support and we'll review it.
  • We may change prices with at least 30 days' advance notice; changes apply from your next renewal after the notice.
  • If a renewal payment fails, we may retry it and will notify you; continued failure may result in suspension of paid features.
  • Prices exclude taxes, which are added where required.

Alluvium — personal finance

Alluvium is a tool for organizing your own financial records. It is for informational and organizational purposes only.

  • We do not provide investment, tax, accounting, credit, or legal advice, and nothing in the Services (including computed figures like budgets, insights, or safe-to-spend estimates and any on-device assistant output) is advice or a recommendation. You are solely responsible for your financial decisions.
  • We do not hold funds, move money, execute transactions, or act as a bank, broker-dealer, money transmitter, or financial advisor.
  • When you connect a financial institution, you direct us and the aggregator you choose (Plaid, MX, or Akoya) to access the accounts you select on your behalf, and you represent that you own those accounts or are authorized to connect them. Your use of an aggregator is also subject to its terms and privacy policy.
  • Synced data can be delayed, incomplete, or wrong, and connections depend on third parties and your institution. Verify balances and transactions against your institution's records before relying on them.

Welkin — network filtering and VPN

Welkin routes an enrolled device's traffic through servers we operate and filters its DNS according to policies you set. Because Welkin necessarily observes and records information about an enrolled device's network activity (described in the Privacy Policy), you must have the right to enroll every device you add.

Consent to monitoring — your responsibility

You may enroll a device only if at least one of the following is true: (a) the device is yours and used by you; (b) the device is used by your minor child or ward, and you are the parent or legal guardian with authority to supervise their internet use; or (c) every adult who uses the device has been clearly informed that its DNS activity will be filtered, recorded in daily summaries, and visible to you (and to anyone you send activity reports to), and has consented. Using Welkin to secretly monitor another adult is prohibited and may violate surveillance, wiretap, or stalking laws. You are solely responsible for complying with the laws that apply to your household and jurisdiction, and you agree we may terminate your access for covert or abusive monitoring.

If you set up activity reports to a recipient, you represent that the recipient has agreed to receive them.

Filtering is not a guarantee

Content filtering is best-effort. Filters rely on third-party domain lists and DNS behavior; they can miss content, block legitimate content, and be circumvented — including simply by turning the tunnel off on the device, using another network, or using apps that bypass DNS. Welkin is a tool to support your household's choices, not a substitute for supervision, and we are not responsible for content that is accessed, or wrongly blocked, on any device.

Acceptable use of the network

  • Do not use the VPN for anything unlawful — including infringement, unauthorized access, sending spam, or distributing malware — or to disrupt networks or evade law-enforcement.
  • We may set fair-use limits on bandwidth and may suspend devices or accounts that degrade the service for others or trigger abuse complaints.
  • The VPN provides encryption in transit to our servers; it does not make you anonymous, and we will comply with valid legal process as described in the Privacy Policy.

Hearth — recipes and meal planning

  • Recipe import fetches a web page at your request and saves its recipe data to your private collection. You are responsible for the URLs you import, and imported content is for your personal, non-commercial household use — importing does not give you or us any rights in third-party content. We keep a link to the original source with each imported recipe.
  • Grocery prices, product matches, and aisle locations are estimates from third-party data (including the Kroger API) and can be outdated or wrong; confirm prices at the store.
  • Nutrition figures are estimates computed from reference data. They are informational only, are not medical, dietary, or allergen advice, and must not be relied on for allergy, medical, or dietary decisions.

Your content

You keep ownership of the data and content you add to the Services. You grant us a limited, non-exclusive license to host, process, transmit, and display it, solely as needed to provide the Services (including showing shared items to your household and sending reports or digests you configure). You are responsible for having the rights to what you upload or import.

Acceptable use

Across all Services, you agree not to:

  • Probe, breach, or test the security of the Services, or access another user's data without authorization.
  • Reverse engineer, scrape, or bulk-extract the Services or their data, or resell or provide the Services to third parties.
  • Upload malware or interfere with the operation of the Services.
  • Circumvent subscription, entitlement, or access controls.
  • Use the Services to violate any law or the rights of others.

Third-party services

The Services interoperate with third parties — Stripe for billing; Plaid, MX, and Akoya for bank aggregation; Kroger and USDA FoodData Central for grocery and nutrition data; Apple and Google platform services; and the providers listed in the Privacy Policy. Their services are governed by their own terms, we do not control them, and we are not responsible for their acts, omissions, or outages.

Mobile apps and the App Store

We license (not sell) you the mobile apps for personal use on devices you own or control, subject to these Terms and the app marketplace's rules. For apps downloaded from Apple's App Store: these Terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support, has no warranty obligation beyond refunding the purchase price (the apps are free), and is not responsible for any claims relating to the apps, including product liability, legal compliance, consumer protection, or IP claims. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you. You represent you are not in an embargoed country or on a US restricted-parties list.

Our intellectual property

We and our licensors own the Services, including the software, design, branding (Apollo Suite, Alluvium, Welkin, Hearth), and documentation. Except for the limited rights these Terms grant, no rights are transferred to you. If you send us feedback, we may use it without obligation.

Termination

You may stop using the Services at any time and may delete your account from Alluvium's Settings or by emailing support; deletion is described in the Privacy Policy. We may suspend or terminate your access for breach of these Terms, non-payment, legal requirement, or discontinuation of the Services (with reasonable notice and a pro-rata refund of prepaid, unused fees in the case of discontinuation). Sections that by their nature survive — including disclaimers, limitations of liability, indemnification, and dispute terms — survive termination.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THAT: WE DO NOT WARRANT THAT SYNCED FINANCIAL DATA IS ACCURATE, COMPLETE, OR TIMELY; THAT CONTENT FILTERING WILL BLOCK ANY PARTICULAR CONTENT OR CANNOT BE BYPASSED; THAT PRICE OR NUTRITION ESTIMATES ARE ACCURATE; OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICES — INCLUDING FINANCIAL DECISIONS MADE USING ALLUVIUM, CONTENT ACCESSED OR BLOCKED (OR NOT BLOCKED) THROUGH WELKIN, OR RELIANCE ON HEARTH'S ESTIMATES — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

Indemnification

To the extent permitted by law, you will defend and indemnify us against claims arising from your content, your violation of these Terms, or your violation of law or the rights of others — including claims arising from enrolling a device in Welkin without the authority or consent these Terms require.

Governing law and disputes

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules, except where the consumer-protection law of your state of residence applies notwithstanding a choice of law. Disputes will be resolved in the state or federal courts located in Utah, and you and we consent to their jurisdiction, except that either party may bring an individual claim in small-claims court where permitted.

Changes to these terms

We may modify these Terms. We will post the updated Terms with a new effective date and, for material changes, notify you through the Services or by email before they take effect. If you continue using the Services after the effective date, the updated Terms apply; if you do not agree, stop using the Services and cancel your subscription.

Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and us about the Services. If a provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delay or failure caused by events beyond our reasonable control.
